The TERMS of the License Agreement include simple and reasonable requirements, e.g.:
The Licensor (Thomas M. Barrett) agrees to grant permission to Licensee (you), the use of Artwork, LOGO designs, and both Tommy B's Philly Cheese and TOMMY B's Registered Trademarks.
The Licensor agrees to provide FREE Training to the Licensee, teaching by demonstration how to make the Tommy B's Menu items.
The Licensor agrees to provide contact information of companies that supply key ingredients and companies that provide uniform embroidery and sign & banner production.
The Licensee understands and agrees that, upon becoming a Licensee with the execution of the Trademark Licensing Agreement, the licensee does not become owner of the two Trademarks, Artwork and LOGO'S, but is granted Permission to Use & Profit from the Trademarks, Artwork and LOGO'S for TOMMY B'S & Tommy B's Philly Cheese.
The Licensee agrees to use the Brand Names of key ingredients spelled out in the agreement;
The Licensee agrees to send "Proof of Purchase" from their distributor, clearly showing the item, quantity, invoice date & number from the distributor (submitted on a Monthly basis);
The Licensee agrees to prepare the Cheesesteaks and all other Tommy B's Menu items in the manner demonstrated on the day of training;
The Licensee agrees to display a Tommy B's sign or banner in an area seen by customer traffic;
The Licensee agrees to display a Menu Poster with the TOMMY B'S LOGO clearly visible; and agrees to a minimum (1) menu item, namely TOMMY B'S PHILLY CHEESESTEAK.
The Licensee agrees to have (a minimum) one staff member wearing a Tommy B's Uniform;
The Licensee understands and agrees that permission to use the TOMMY B'S LOGO for any recipe developed by licensee, must be approved in writing by Licensor;
The Licensee understands and agrees that there are no refunds for any signage, Menu Posters and Uniforms purchased by the licensee;
The Licensee understands and agrees that the Licensor, Thomas M. Barrett, dba Tommy B's and Tommy B's Philly Cheese, does not and cannot guarantee the success of their Food Business with the addition & installation of Tommy B's Trademark Licensing Program.
The Licensee agrees to forfeit all rights to use of Trademarks, Artwork and LOGO'S, if the licensee is in breach of this Agreement.
If a breach of Agreement occurs, resulting in termination of such Agreement, the licensee agrees to surrender all Signage, Artwork files, Uniforms, promptly returning all such items to Thomas M. Barrett. No Refunds.
The Licensee may terminate and exit the license agreement at any time and for any reason, and then must return (without refund) all signage, uniforms and electronic files containing artwork and graphics, forfeiting all rights to use of such materials owned by Thomas M. Barrett, dba TOMMY B'S and Tommy B's Philly Cheese.
Thomas M. Barrett agrees to grant a Trademark License for an indefinite period, contingent upon licensee observing all Terms of Trademark Licensing Agreement.
